It’s understandable if you have never heard of probate lawyers, but one day, when someone you love passes, you’ll need one.
This type of lawyer is one who deals with the filing of the last testament or will of a deceased person. We’ve all seen a movie or TV show that has a family or loved ones gathered around a lawyer issuing who get’s what from the deceased will. This is of course the probate lawyer.
Because none of us want to think about someone we love passing on, it’s easy not to also think about acquiring the services of such a lawyer. If at the time of the inevitable you have not found a lawyer you think will best represent your interests, you will probably be faced with a sense of urgency to find one. That is something you don’t need regardless of the degree of the estate planned by the deceased while they were living. These lawyers are best fitted for family situations given the type of law they practice so it is very important to shop around for one that best suits your family.
Estate lawyer, or will lawyers will be able to locate and secure both probate and non-probate assets, collect life insurance proceeds (which can be very important), address issues with income taxes, offer services to assist in the sale of the estate property, and file the documents needed for probate court in a timely manor.
Probate proceedings in the state of California are conducted in the Superior Court for the county in which the decedent lived. These proceedings can take up to several years to come to a close.
